Corporate Trustee or Executor of Your Estate

Estate administration is complex and highly detailed — and not a job for the inexperienced. Your choice for the executor of your estate deserves serious consideration. Inexperience may lead to errors in judgment, which in turn can prove costly to your beneficiaries. As tax laws and accounting practices become increasingly complex, it is essential to have a competent and experienced executor.

An important facet of the estate planning process is deciding who will be the executor of your estate. Your choice should be named in your will. If you fail to nominate an executor, the state may appoint an executor for you.

Executor responsibilities:

  • locate the will and file it in court
  • obtain death certificates (and sometimes birth and marriage certificates as well)
  • pay the estate’s expenses
  • pay the decedent’s debts
  • assemble all assets, including deeds and contracts
  • collect all debts owed to the estate
  • keep complete and accurate records of all the estate’s transactions
  • collect, value, inventory and protect all the assets of the estate
  • file all necessary tax returns
  • prepare an accounting for the probate court and the beneficiaries
  • distribute all estate assets as directed by the will
